Terms of Service

1. Scope

These Terms govern your use of the PokerGTO Pro web application at pokergto.pro (the “Service”), operated by Adriano Zuccala (Anbieterangaben werden vor Verkaufsstart vervollständigt.) (“we”, “us”). By creating an account you agree to these Terms and to our Privacy Policy.

2. The service

PokerGTO Pro is an educational tool. It provides interactive GTO poker range charts, equity and pot-odds calculators, and a practice quiz. The Service is offered “as is”; we make no guarantees of specific poker results or profit.

You must be at least 18 years old and legally permitted in your jurisdiction to learn about / play poker. We do not host real-money play.

3. Account

You are responsible for keeping your login credentials secure. You must provide accurate information. We may suspend an account that breaches these Terms or is being used for abuse (scraping, reverse engineering, credential-sharing at scale).

4. Free and Pro plans

The Free plan is provided at no cost with limited features (RFI ranges only, basic equity, 5 quiz questions per day). The Pro plan unlocks the full feature set and is billed via Stripe on a recurring basis.

Current Pro pricing (VAT where applicable included):

• Monthly: €19/month
• Annual: €182.40/year (€15.20/month, billed once per year — 20% saving)

5. Auto-renewal

Pro subscriptions renew automatically at the end of each billing period — monthly subscriptions at the end of each month, annual at the end of each year. Renewal happens at the price in effect at renewal time; we will notify you at least 14 days in advance of any price change.

You can cancel at any time from Settings → Subscription → Manage subscription. Cancellation takes effect at the end of the current billing period; you keep Pro access until then and are not charged again.

6. Statutory right of withdrawal (Widerrufsrecht)

As an EU consumer you have a 14-day withdrawal right for digital services under §§312g, 355 BGB. When you take out the paid Pro subscription, you expressly consent at checkout that we begin providing the Service before the withdrawal period ends, and you acknowledge that your right of withdrawal expires once we have fully performed the contract per §356(4) BGB. If you withdraw after performance has begun at your request, you owe a proportionate amount for the part of the Service already provided up to that point. You can still cancel the recurring subscription at any time under Section 5 above. The full German withdrawal notice (Widerrufsbelehrung) and the model withdrawal form are part of the AGB.

7. Refunds

We do not pro-rate refunds for partial periods. If you cancel mid-month, you keep access until the period ends. If a charge was clearly made in error (e.g. double billing), email adriano.zuccala.hh@gmail.com and we will refund within 14 days.

8. Acceptable use

You agree not to:

• scrape, copy, or resell our range data or derived content;
• reverse engineer or disassemble any part of the Service;
• circumvent the Free-tier limits with multiple accounts;
• upload content that is unlawful, infringing, harassing, or designed to gain unauthorized access.

9. Intellectual property

The Service, range data, and UI are our intellectual property. You retain ownership of any content you upload (currently none; reserved for future hand-history import). Using the Service does not transfer any IP rights to you other than a non-exclusive, non-transferable right to use it for your personal poker study.

10. Limitation of liability

To the extent permitted by law, our liability is limited to damages caused by gross negligence or intent. We are not liable for ordinary negligence unless a cardinal contractual obligation is breached, in which case liability is limited to typical, foreseeable damages. Mandatory statutory liability (e.g. under the Product Liability Act) remains unaffected.

11. Term and termination

These Terms remain in effect while you have an account. You can terminate at any time via Settings → Delete account. We can terminate for breach with reasonable notice.

12. Governing law & jurisdiction

German law applies, excluding the CISG. For consumers, this does not displace mandatory protections of your country of residence. Place of jurisdiction for merchants is Hamburg, Deutschland.

13. EU online dispute resolution

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and do not participate, in consumer arbitration procedures.
